Terms of Use

These Terms of Use ("Terms") govern your use of the Remember This, Mate iOS application ("App") provided by Serious Fish ("we", "us", or "our"). By creating an account or using the App, you confirm that you have read, understood, and agree to these Terms.

We grant you a limited, non-exclusive, non-transferable, revocable licence to install and use the App on devices that you own or control, for your personal, non-commercial use, subject to these Terms.

You may not:

• Copy, modify, or distribute the App or any portion of it.
• Reverse engineer, decompile, or disassemble the App.
• Use the App for any unlawful purpose or in violation of any regulations.
• Attempt to gain unauthorised access to any part of the App or its infrastructure.

To use the App, you must create an account using a valid email address. You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activity that occurs under your account.
• Notifying us immediately of any unauthorised use of your account.

We reserve the right to terminate accounts that violate these Terms.

You must be at least 13 years old to use the App. If you are under 18, you represent that you have your parent or guardian's permission to use the App. We do not knowingly collect data from children under 13.

You retain ownership of any content you create within the App, including item names, notes, tags, photos, and location data ("User Content").

By using the App, you grant us a limited licence to store and process your User Content solely for the purpose of providing the App's services to you.

You are responsible for ensuring that your User Content does not violate any third-party rights or applicable laws. You must not upload content that is illegal, harmful, or infringes on the intellectual property of others.

You agree not to use the App to:

• Track the location of items belonging to others without their knowledge or consent.
• Engage in any activity that violates applicable local, national, or international law.
• Transmit any harmful, offensive, or illegal content.
• Attempt to disrupt or interfere with the App's servers or networks.
• Use the App for surveillance, stalking, or any activity that infringes on another person's privacy.

The App and all its original content, features, and functionality are owned by Serious Fish and are protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any intellectual property rights to you.

Apple, the Apple logo, and iPhone are trademarks of Apple Inc., registered in the U.S. and other countries. Apple is not a sponsor of or affiliated with Remember This, Mate.

The App uses third-party services including Supabase (backend infrastructure) and Apple MapKit (mapping). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of these third-party providers.

The App is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied. We do not warrant that:

• The App will be uninterrupted, error-free, or secure.
• Any data stored in the App will be preserved without loss.
• The App will meet your specific requirements.

You use the App at your own risk. We strongly recommend maintaining your own backups of any important information.

To the maximum extent permitted by law, Serious Fish shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, arising from your use of or inability to use the App.

Our total liability for any claim arising from your use of the App shall not exceed the amount you paid for the App in the 12 months prior to the claim (if any).

You agree to indemnify and hold harmless Serious Fish, its affiliates, and its employees from any claims, losses, damages, or expenses (including reasonable legal fees) arising from your use of the App, your User Content, or your violation of these Terms.

We may terminate or suspend your access to the App at our discretion, without notice, if you violate these Terms or for any other reason. Upon termination, your right to use the App ceases immediately.

You may terminate your account at any time by emailing support@seriousfish.com. On termination, your data will be deleted in accordance with our Privacy Policy.

These Terms are governed by and construed in accordance with the laws of Australia, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Australia.

We reserve the right to modify these Terms at any time. We will notify users of significant changes by updating the "Last updated" date. Your continued use of the App after changes constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the App.
